Despite being the usual conditions of sale, Malfattistore advises you to read them carefully since placing an order implies their acceptance.
1) “malfattistore” is a trademark owned by Zorzan Malfatti sas of Vicenza, Italy, (registration in the Vicenza business register, REA no. 151918) which identifies its website dedicated to e-commerce.
It is forbidden to copy, reproduce, publish or distribute what is contained on the site without the prior written consent of the Zorzan Malfatti sas company.
2) Purchases: The purchase order must be received online using the appropriate form. Before the next order confirmation, the customer will receive the following information:
– Identity and address of “Malfattistore”
– Characteristics of the good or service
– Price of the good or service, cost of shipping, amount of any taxes.
– Methods of payment, delivery of the goods and any other form of contract execution
– Existence of the right of withdrawal or exclusion thereof
– Methods and times for returning or collecting the goods in case of exercising the right of withdrawal
– For each purchase, a regular sales invoice will be issued.
3) Prices: All prices are expressed in euros and include Value Added Tax (VAT). U.E. customers “Without VAT” will have to pay the 22% VAT tax in Italy. U.E. customers “With VAT” will pay the VAT tax of their country.
Non-EU customers they will pay their country’s taxes.
The prices in the Product data sheets do not include shipping costs and their accessories. Packaging costs are already included in the product price, except for special requests.
4) Payments: Our prices are designed for advance payment.
Payments can be made in the following ways:

The order will not be processed until payment has been credited. Why choose the bank transfer: to exceed the payment limit of some credit cards.

PayPal is a leader in online payments and you can use the main credit cards such as Visa, Mastercard, Postepay, American Express.
5) Shipping: For shipping costs not specified, a quote must be requested to the site manager. The cheapest rate will always be applied. Remember to always provide instructions for the courier (timetable, access problems, etc …) The standard shipping does not include possible supplements for locations that require the use of means of delivery other than the usual ones (trucks 7 – 12 meters), such as pedestrian areas, construction sites or smaller islands. If you plan to meet these characteristics, contact us before purchasing for a better service: any non-notification before purchase involves billing at the time of delivery. It is possible to change the shipping address within fifteen days of the order by sending an email to info@malfattistore.it specifying the new shipping address.
6) Delivery: the delivery service takes place at street level and the customer must collaborate with the driver to unload the packages from the side of the truck, depending on the weight and size of the purchased item. Delivery times may vary depending on the availability of products in stock or not. The delivery terms indicated in the purchase order are purely indicative and, in any case, not essential for the customer. Without prejudice to cases of willful misconduct and gross negligence, any liability of “Malfattistore” for a delay in the delivery of products is excluded. We specify that the productions and deliveries scheduled in the periods preceding the Christmas holidays or the summer holidays could suffer substantial delays related to the contingency of the period.
7) Damages: In the event that at the time of delivery deficiencies or damage are ascertained due to obvious causes of transport, “Malfattistore” will take charge of it, without any burden on the part of the customer, provided, however, that an explicit mention is made on the document accompanying the goods and communication to the manager by e-mail. To better protect yourself in the event of any production defects or transport damage, you are required to correctly follow the procedure for receiving and verifying the following products: Check the number of packages and if the number does not correspond to that of the document of transport, note the missing package; check the external condition of the packages and photograph them. If the packaging is not intact and has dents, torn or wet parts, it is essential to sign with the words “with reserve for torn / wet / dented packaging”; generic reservations are not accepted. In case of product with visible anomaly, sign with the word “damaged product”. Open the packages with extreme care especially if you use cutters or blades. Sharp objects used during the opening of the packages are among the main causes of damage and being recognizable signs they are not covered by the guarantee. Check the items before assembly and in case of anomalies, photograph the affected part in detail before proceeding with the possible removal of the packaging or assembly. Handle packages with extreme care; in case of bulky or particularly heavy volumes get help from a second person. During assembly follow the instructions, they are normally included in the supply. If there are any anomalies during assembly, photograph the anomaly before completing assembly, then contacting Customer Service to check how to proceed. Always keep the original packaging, because in case of replacement it is necessary to reuse the original packaging.
If the conditions of the product are such that you believe there is an anomaly caused by a production defect or transport damage, we ask you to report it promptly. Reporting on the external condition of the packages must take place on the day of unloading of the supply or at the following morning at the latest. The report on the integrity of the items after opening the packaging must take place within 48 hours of unloading. Each report must be made by sending an email with the order number, the description of the problem encountered with the photographic documentation attached.
If the customer does not follow the points indicated in the procedure, the possible impossibility of attributing specific responsibility for the problem encountered may occur. Therefore, it may be necessary to involve the customer in any replacement costs. In these cases, MalfattiStore works for customer satisfaction, however, reserving a specific evaluation from case to case. Each procedure expressed herein serves to protect our customers effectively.
8) Right of withdrawal: The customer has the right of withdrawal, except for “non-prefabricated goods produced on the basis of an individual choice or decision of the consumer” (Directive 2011/83 / EU of the European Parliament) and for “custom-made goods or clearly personalized “(art. 59 Legislative Decree 21/2014). The customer can exercise this right within 14 days of receipt of the goods by sending a registered letter with acknowledgment of receipt to Zorzan Malfatti sas, via 4 Novembre 39, 36100 Vicenza, Italy.
The integrity of the goods and packaging are essential conditions for exercising the right of withdrawal. The goods must be sent perfectly packed together with the accompanying note received at the time of delivery. The return must take place within 14 days of receipt of the goods with shipping costs charged to the customer. The goods must be sent to the following address: Zorzan Malfatti sas, via 4 Novembre 39, 36100 Vicenza, Italy. The refund will be made within 30 days of receipt of the returned goods (only the cost of the goods). The reimbursement excludes any incidental costs and will take place by bank transfer. 9) Personal data: Pursuant to article 10 of law 675/96, the personal data provided by customers will be used by “Malfattistore” and Zorzan Malfatti sas also with the aid of electronic and / or automated tools, exclusively for commercial purposes attributable to the company activity.
Pursuant to article 13 of law 675/96, the interested parties have the right to modify their data by requesting their correction, integration and, if necessary, the erasure or blocking.
10) Disputes: Any dispute will be governed and interpreted in accordance with Italian laws.
11) Colors: The colors shown in the website pages are purely indicative and not binding.
12) Photographs: The photographs shown in the website pages are purely indicative and not binding.
13) Retention of title: pursuant to and for the purposes of articles 1523-1526 of the Civil Code, the transfer of ownership of the products from “Malfattistore” to the customer will take place with full payment of the price. In the event of sale by installments and default of the buyer, the installments already paid will be retained by “Malfattistore” as an indemnity.
14) Certifications: Certifications are available on request for products that have certified them.
15) Computer registers: The computer registers, kept in the computer records of “Malfattistore” in reasonable security conditions, will be considered as demonstration of the communications, orders and payments made between the parties.
